If, when we pray relying on our own merit, our prayers are granted on someone else's merit, and vice versa; doesn't this provide an easy out for a rasha - they could just pray on their own merit and know that their prayers will be granted according to the merit of the Avot, or Moshe Rabeinu, or some tremendous tzaddik.  How is this just?

Could it be that such a case wouldnt really work becuase the rasha probably wouldnt get his prayers answered because of echta vashuv, he doesnt get the teshuvah because he's working the system of Torah for the wrong reasons. I'm assuming this rasha will then go back to ebing a rasha and as such his prayers wont be answered.
